It’s important to keep up with the current laws and regulations surrounding hemp and CBD related products, especially since some states differ.
Federal Law
As of November 2018, CBD (or cannabidiol) is now federally legal as long as it’s made from hemp with less than 0.3% THC content. This means you can legally possess and use hemp or CBD products within these parameters.
However, the FDA still classifies parts of the hemp plant as a Schedule 1 drug and is working on implementing industry regulations to ensure your safety. Depending on what transpires, certain hemp or CBD related products may not be available in the future.
State Laws
Each state has their own laws on cannabis or hemp. Most states allow the purchase of CBD and hemp products from any vendor in any form, while some states require these items to be purchased in licensed dispensaries or in certain forms.
Just Peachy CBD recommends checking your local laws or guidelines due to discrepancies. Texas is an example of a state where CBD tinctures are legal, but smoking CBD or hemp flower is not.

Since most hemp related products include trace amounts of THC, it is possible for you to fail a drug test depending on the type of test you are given.
The only exception is CBD Isolate products where all cannabinoids except CBD have been removed.
Even though hemp products with THC levels of 0.3% or less are federally legal, some companies and organizations have a zero-tolerance policy for positive results.

Hemp or CBD products that adhere to the strict federal guidelines will not get you high or intoxicated.

Under the Hemp Farming Act of 2018 all hemp or CBD related products must remain under .03% THC. This limit of THC is not enough to cause any intoxication or impairment of any kind.

Please note: There are cannabis legal states who allow CBD products to be sold with higher concentrations of THC.

Purchasing products with higher amounts of THC will cause you to feel high or intoxicated. If you visit a dispensary for medical or adult-use, please read the labels or ask questions.
